Terms of Service

1. Acceptance of Terms

By accessing or using the AVPN platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

AVPN provides cloud-based archive and video preservation services, including durable cold storage, adaptive streaming previews, bulk retrieval, and metadata cataloguing. The Service is provided by AVPN Ltd., a company registered in England and Wales (company number 12847593), with its registered office at 71 Queen Victoria Street, London, EC4V 4AY.

3. Account Registration

You must provide accurate, complete registration information. You are responsible for safeguarding your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree not to use the Service to store, stream, or distribute content that is unlawful, infringes intellectual property rights, or violates applicable regulations. You retain all ownership rights to content you upload. By uploading content, you grant AVPN a limited license to store, process, and serve that content solely for the purpose of providing the Service.

5. Service Level Commitment

AVPN targets an annual durability of 99.9999% for stored objects. We commit to 99.9% monthly uptime availability for the streaming and retrieval APIs. Details of our SLA, including eligible credits for downtime, are described in our separate Service Level Agreement document.

6. Payment and Billing

Paid plans are billed monthly in advance. Usage-based charges (storage, retrieval, streaming) are calculated at the rates published on our pricing page and invoiced in arrears. All fees are exclusive of applicable taxes. We reserve the right to modify pricing with 30 days' written notice.

7. Data Retention and Deletion

You may delete your stored content at any time through the Service interface or API. Upon account termination, we will retain your data for 90 days, after which it will be permanently and irrecoverably deleted unless you request an earlier deletion or arrange a data export.

8. Limitation of Liability

To the maximum extent permitted by law, AVPN shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our total aggregate liability shall not exceed the amount paid by you in the twelve months preceding the claim.

9. Modifications

We may revise these Terms from time to time. Material changes will be communicated via email or a notice on the Service. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

10. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of London, England.
